Finance Committee Notice Regarding Councillor’s Remuneration

First Nation of Nacho Nyak Dun Finance Committee, with members present: Florence Moses, Millie Olsen, Rose Lemieux, Kathleen Lundgaard, Norma Jean Germaine and adopted by consensus this 7th day of March, 2023:  

Whereas: Section 11 of the First Nation of Nacho Nyak Dun Government Act provides that:

The Council shall determine its own procedure, and any failure by the Council to adhere to or follow its own procedure shall not be reviewable by any court and shall not affect the validity of any Council proceeding or decision.

And Whereas: Section 19 of the First Nation of Nacho Nyak Dun Government Act provides, in material part, that “each Council member will be paid a wage and reasonable and living expenses incurred in connection with the performance of his or her duties while away from his or her ordinary place of residence… at a rate approved by the Finance Committee or set out in the Regulations. [emphasis added]

And Whereas: Three General Assembly or General Meeting resolutions since 2019 have been brought forward ending with the most recent, the 2021 October 22-24, General Meeting Resolution #001 reflects both recommendations and instructions directing as follows:

“…. Following the next general election for Council under the Election Act, the Chief and Deputy Chief will be paid full-time salaries and the Councillors, including the Elder Councillor and the Youth Councillor, will be paid a reasonable honoraria for the time required to carry out their duties and responsibilities in accordance with a policy developed in consultation with citizens, that takes into account Northern Governance Institution’s recommendations, before the upcoming general election.”

And Whereas: The Finance Committee, confident in the scope of its responsibilities, duties and authority, has given extensive consideration to all of the Acts, policies and regulations within the First Nation of Nacho Nyak Dun, its law making powers, the Constitution and various definitions thereunder. Further, the Finance Committee has given full and fair consideration to all research and advice that has been provided to date on this subject.

Therefore be it Resolved that: The Finance Committee sets the following salaried rates for the Chief and Deputy Chief at a rate equal with the annual salaried rates in effect as of today’s date.

Further Be it Resolved that:

The following reasonable salaried monthly payments for the Councillors, including the Elder Councillor and the Youth Councillors be set at a salaried monthly rate not to exceed $2500 per month and not less than $500 per day or $250 per half day effective April 20th, 2023.

Further Be it Resolved that: The Finance Committee recommends that the rates be reviewed within two years and within the two year time-frame, no later than April 20th, 2025, as was originally directed by the 2021 October 22-24 General Meeting resolution #001 that: “a policy or regulation be developed in consultation with citizens” that shall include a process, criteria and/or grid setting in parallel with the Constitution review process, such that acts, policies, regulations be reviewed for consistencies and integration with legislative and operational requirements.
